Terms of Service

These terms govern your use of the Tectonic Rentals website and rental services. By using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using the website at tectonic.rentals or renting equipment from Tectonic Rentals Inc., operating as Tectonic Rentals (“we,” “us,” or “our”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our services.

We reserve the right to update these terms at any time. Continued use of our services after changes constitutes acceptance of the revised terms.

2. Equipment Rental Terms

2.1 Rental Agreement

All equipment rentals are subject to a separate Rental Agreement that must be signed before equipment is released. The Rental Agreement, combined with these Terms, forms the complete agreement between you and Tectonic Rentals.

2.2 Rental Period

  • Rental days are counted by the number of nights equipment is kept off-site. Saturday and Sunday nights are always excluded.
  • Any rental of 24 hours or less is billed as one full day. Pickup and return on the same day constitutes one rental day.
  • Rentals of 1–2 rental days are billed at the base daily rate. Rentals of 3–6 rental days receive a 20% discount on all days. Rentals of 7 or more rental days receive a 30% discount on all days (Tectonic Flexibility Pricing Tier).
  • If the Renter returns Equipment early, the final invoice will be adjusted to reflect the rate tier actually utilized.
  • Late returns beyond the agreed period will be charged at the applicable daily rate.

2.3 Quotes & Bookings

  • Quotes provided through our website or by our team are valid for the period specified (typically 3-30 days).
  • All quotes are subject to equipment availability at the time of booking confirmation.
  • Pricing may change without notice for future quotes, but confirmed bookings are honoured at the quoted price.

2.4 Equipment Use

  • Equipment must be operated by qualified personnel in accordance with manufacturer guidelines and applicable safety regulations.
  • Renter is responsible for ensuring all operators are properly trained and licensed where required.
  • Equipment must not be modified, altered, or used beyond its rated capacity.
  • Equipment must not be sublet, transferred, or moved to a location other than the designated job site without written consent.

3. Payments & Pricing

3.1 Payment Terms

  • Homeowner Rentals: Payment is due at the time of booking confirmation. Accepted methods include credit card (Visa, Mastercard), Interac e-Transfer, cash, or cheque.
  • Contractor Accounts: Approved contractors may be eligible for Net 30 payment terms. Late payments are subject to 2% monthly interest charges on outstanding balances.

3.2 Taxes

Tectonic Rentals is not currently registered for GST/HST. No sales tax is applied to rental charges at this time. Should this change in the future, applicable taxes will be clearly disclosed on all quotes and invoices.

3.3 Delivery Fees

Delivery and pickup from our Pickering yard is the default option. Site delivery is available starting at $150 within 25km, with pricing based on distance. Delivery pricing is provided at the time of quoting.

3.4 Cancellation

  • Cancellations made before equipment dispatch are eligible for a full refund.
  • Cancellations after equipment has been dispatched may be subject to a delivery fee charge.
  • No-shows will be charged for a minimum of one day’s rental plus delivery fees if applicable.

4. Tectonic Protection Plan (TPP)

The Tectonic Protection Plan is an optional damage protection program available for all rentals.

  • TPP costs 13% of the total rental amount.
  • With TPP, the renter’s maximum out-of-pocket liability for accidental damage is capped at 10% of the repair or replacement cost.
  • Without TPP, the renter is responsible for the full cost of repair or replacement of damaged equipment.
  • TPP does not cover intentional misuse, negligence, theft, or use beyond the equipment’s rated capacity.
  • Renters may alternatively provide proof of commercial liability insurance covering rented equipment.

5. Liability & Responsibility

5.1 Renter Responsibility

  • The renter assumes full responsibility for the rented equipment from the time of pickup or delivery until the equipment is returned or collected.
  • The renter is responsible for any damage, loss, or theft of equipment during the rental period.
  • The renter must return equipment in the same condition as received, subject to normal wear and tear.
  • The renter is responsible for fueling diesel-powered equipment. Equipment must be returned with a full tank; otherwise, a refueling charge will apply.

5.2 Limitation of Liability

To the maximum extent permitted by Ontario and Canadian law, Tectonic Rentals shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of rented equipment, including but not limited to lost profits, business interruption, or project delays.

Our total liability for any claim shall not exceed the total rental amount paid for the specific rental in question.

5.3 Indemnification

You agree to indemnify and hold harmless Tectonic Rentals, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your use of rented equipment, violation of these terms, or negligence.

6. Website Use

6.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized use of your account. Passwords must meet our minimum security requirements (8+ characters with uppercase, lowercase, number, and special character).

6.2 Prohibited Conduct

  • Attempting to gain unauthorized access to our systems, accounts, or data.
  • Using automated tools to scrape, crawl, or extract data from our website.
  • Submitting false, misleading, or fraudulent information.
  • Interfering with or disrupting the integrity or performance of our website.
  • Using our services for any unlawful purpose.

6.3 Intellectual Property

All content on the Tectonic Rentals website — including text, images, logos, branding, and software — is our property or licensed to us and is protected by Canadian intellectual property law. You may not reproduce, distribute, or create derivative works without written permission.

7. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If a dispute cannot be resolved informally within 30 days, the matter shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of Ontario shall have exclusive jurisdiction.

8. Termination

We reserve the right to suspend or terminate your account or access to our services at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.

Upon termination, your right to use our services ceases immediately. Any outstanding rental obligations, unpaid invoices, or damage charges survive termination.

9. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
